Under data protection law, you have the right to be informed (amongst other rights), this means that the College must communicate to you how we process your data, who we share your data with, what your rights are and how long we keep your information for. We collect your personal data as detailed on this form. We share your information with the statutory bodies we are required to report to, e.g. Scottish Funding Council (SFC), Skills Development Scotland (SDS) etc. We are required to collect this information under the Post-16 Education (Scotland) Act 2013 and the Further and Higher Education (Scotland) Act 2005. We only hold your data for the period of time that you study at the College and 5 further years. Following this your information will be destroyed securely, in line with College procedures. LIMITED LIABILITY
Borders College has the right to amend the content and/or the requirements of the courses without any form of compensation becoming payable to students. In the event of a course being cancelled, the College’s liability will be limited to a refund of fees already paid.
DATA PROTECTION
The College is registered under the Data Protection Act 1998. The information provided in the form and results achieved, may be shared with the relevant organisations and partners, including Awarding bodies, Scottish Funding Council and Skills Development Scotland. The methods of storing and using your information are subject to other Acts of Parliament. Sensitive data will only be shared with the Scottish Funding Council for statistical purposes.
ADVANCED DISCLOSURE CHECKS
For some courses where the students may have a work experience placement working with children or vulnerable adults the College requires the successful applicants to undergo enhanced disclosure checks. For these courses you are also required to disclose all convictions both spent and unspent under the Rehabilitation of Offenders Act 1974 (Exclusions and Exception) (Scotland) Order 2003. The Act states that any person who comes into contact with young people under the age of 18 during their course must declare all previous convictions – spent or not. Therefore failure to do so may result in dismissal from your course. This applies only to all care courses and some sports courses.
