We collect your personal data as detailed on this form. We share your information with the statutory bodies we are required to report to, e.g. Scottish Funding Council (SFC), Skills Development Scotland (SDS) etc. We are required to collect this information under the Post-16 Education (Scotland) Act 2013 and the Further and Higher Education (Scotland) Act 2005. The College will accept applications from individuals with a criminal record on their merits, only taking into account convictions considered to be relevant to the course applied for. You will be required to supply details in a letter marked 'Private and Confidential' detailing the conviction(s). The content of the letter should outline the incidents(s), when it was, how it was dealt with (i.e. sentence received), explanation of circumstances at the time and what are your current circumstances. For some courses where the students may have a work experience placement working with children or vulnerable adults the College requires the successful applicants to undergo enhanced disclosure checks. For these courses you are also required to disclose all convictions both spent and unspent under the Rehabilitation of Offenders Act 1974 (Exclusions and Exception) (Scotland) Order 2003. The Act states that any person who comes into contact with young people under the age of 18 during their course must declare all previous convictions – spent or not. Therefore failure to do so may result in dismissal from your course. This applies only to all care courses and some sports courses.
